Terms of sale

registered with the Commercial and Companies Registry of TOULON under SIRET number 44902249000048,
in his capacity as manager and publication director of the online creation and sales shop “PlaSteel Forge,” duly authorized for the purposes hereof,
(“Seller” or “the Company”),
And the natural or legal person purchasing products or services from the company,
(hereinafter “Buyer” or “Customer”),
It is hereby agreed as follows:
The Seller publishes Products and Services intended for consumers, marketed through its website(s) (https://www.plasteelforge.com). The list and descriptions of goods and services offered by the Company may be consulted on the aforementioned websites.
Article 1: Purpose
These Terms and Conditions of Sale establish the rights and obligations of the parties in relation to the online sale of Products or Services offered by the Seller.
Article 2: General Provisions
These Terms and Conditions of Sale (“TCS”) govern the sale of Products or Services made via the Company’s websites and are an integral part of the Contract between Buyer and Seller. They are fully binding on the Buyer, who accepted them prior to placing an order.
The Seller reserves the right to modify these terms at any time by publishing a new version on its website. The TCS applicable will be those in force at the date of payment (or the date of the first payment in the case of multiple payments). These TCS can be viewed on the Company’s website at https://www.plasteelforge.com.
The Company ensures that acceptance is clear and unreserved by requiring a check box and click confirmation. The Customer declares having read all present TCS, and if applicable, any Special Terms applicable to a product or service, and accepts them without restriction.
The Customer acknowledges having received all necessary information and advice to ensure the suitability of the offer to his needs.
The Customer declares being legally capable of entering into this contract under French law or validly representing the person for whom he is acting.
Unless proven otherwise, information recorded by the Company constitutes proof of all transactions.
The site PlaSteel Forge allows the sale of products manufactured mostly by the Seller (“Products”) to Internet users (“Customer”).
Part of the site operates on a made-to-order basis. By placing an order, the customer acknowledges that the time before shipment (production time) may vary for each product, and that each product page indicates an estimated production time. If the product is not shipped within the indicated time and the customer requests a refund before shipment, a full refund will be issued. Otherwise, the customer can only be reimbursed after returning the product in good condition at their own expense. For limited production runs, if the customer purchases from stock, they acknowledge they may not change size or variant (e.g. color) after receipt. If the customer wishes to be refunded for a preorder or in-stock item and makes that request, refund processing will begin once the returned item is received. All orders or preorders (“Orders” or “Preorders”) placed on the Site imply prior consultation and irrevocable acceptance of these TCS. The Customer acknowledges being informed that acceptance does not require a handwritten signature as long as the Buyer orders online the Products presented. The Customer declares legal capacity (i.e. 18 years or older, not under legal guardianship). The parties agree that their relationship is governed solely by these TCS.
Article 3: Prices
Prices of products sold through the sites are quoted in Euros net, the seller not being subject to VAT (plus any other applicable taxes) on the order page. They are also quoted excluding specific shipping fees. Customs duties or import taxes may apply in certain cases; such costs are the responsibility of the Buyer. The Seller may modify prices at any time. Telecommunication costs to access the websites are the responsibility of the Customer, as are delivery fees where applicable.
Article 4: Conclusion of the Online Contract
In accordance with Article 1127-1 of the French Civil Code, the Customer must follow a series of steps to conclude the contract electronically: – Information on essential product characteristics; – selecting product and options; – providing client details (name, email, address, etc.); – acceptance of these TCS; – verifying order details and correcting errors; – confirming the order finalizes the contract; – following payment instructions, paying product and shipping costs, then delivery. Confirmation email is sent. The Buyer can correct input errors during checkout. The language of the contract conclusion is French. The TCS and order details are emailed and archived, and they are available on the Seller’s site. Communications, order details and invoices are archived reliably in compliance with Article 1360 of the French Civil Code and may serve as evidence. Products are delivered to the address provided by the Customer. The Seller may refuse orders in certain cases (abuse, suspicious or illicit requests).
Article 5: Products and Services
Essential characteristics, prices, and usage of products and services are made available to the Buyer via the sites. The total amount due is displayed at checkout. Delivery fees are indicated before confirmation. The Seller may modify prices for future orders. When products or services are not delivered immediately, clear information is provided about shipment and delivery timing. The customer acknowledges having received all contract details (delivery, payment, seller identity). The Seller commits to fulfilling orders subject to available stock. If unavailable, the Customer is informed; if order already placed and no agreement for a new date, a refund is issued. Illustrations or photographs are non-binding. Validity periods of offers and prices are noted on the websites. Unless otherwise stated, rights granted are personal to the ordering person.
In compliance with French consumer law, the Seller bears guarantees of conformity and hidden defects. Defective or non-conforming products may be refunded or exchanged, as per procedure. A commercial guarantee, if any, must be specified.
Article 7: Retention of Title Clause
Products remain property of the Company until full payment.
Article 8: Delivery Terms
Products are delivered to the address provided on order and within indicated timeframes (excluding preparation time). Multiple products may have different delivery schedules. In case of delay, the Customer may terminate under Article L.216-2 of the French Consumer Code. The Seller refunds product and outbound shipping in accordance with Articles L.216-3 and L.241-4. Risk transfers to Customer upon physical receipt; Customer must notify carrier of any damage.
Article 9: Availability and Presentation
If an item becomes unavailable beyond 5 working days past its scheduled production time, the Customer is notified of revised delivery times and may cancel the order for full refund or credit.
Article 10: Payment
Payment is due immediately at order, including for preorders. Payment may be made by card via PayPal. Cards issued outside France must be international (Visa, Mastercard). Payment is secured by PayPal. Transactions are irrevocable under French monetary law. Customer authorizes debiting of card or account.
Article 11: Withdrawal Period
Pursuant to Article L 221-5 of the French Consumer Code, the Buyer has 14 days from receipt to withdraw without justification by contacting the Company at plasteelforge@sfr.fr. This right does not apply to custom-made or clearly personalized goods or services executed fully before the end of withdrawal period. Refund of product and shipping costs (excluding return fee borne by Customer) applies. Products must be returned in original condition with packaging and accessories.
Article 12: Guarantees
The Seller provides statutory guarantees of conformity and hidden defects. Refund or exchange of defective or non-conforming products is possible by written request or via email / customer area.
Article 13: Complaints and Mediation
The Buyer may submit complaints by email at plasteelforge@sfr.fr. Under consumer law, mediation may be used if Customer’s claim is unanswered within two months. The mediator XXX may be used to reach amicable resolution.
Article 14: Contract Termination
The Customer may terminate by registered letter if non-conformity, late delivery (beyond guarantee), price increase, or product modification. The Buyer may demand refund of deposit plus interest.
Article 15: Intellectual Property
Trademarks, domain names, products, software, images, texts, etc. remain exclusive property of the Seller. No transfer of intellectual property rights is granted under these TCS. Any reproduction or modification is strictly forbidden.
Article 16: Force Majeure
The Seller’s obligations are suspended in the event of force majeure. The Seller shall notify the Customer in case of such event.
Article 17: Nullity and Modification
If one stipulation is invalid, others remain in force. Any modification is valid only by written agreement.
Article 18: Personal Data Protection
In accordance with Regulation (EU) 2016/679 (GDPR), the Seller implements personal data processing for sales and delivery. The Buyer is informed of the data controller, legal basis (contract performance), recipients, data retention period, rights of access, rectification, erasure, opposition, portability, complaint rights. No automated decision or profiling is implemented in ordering.
Article 19: Applicable Law
All provisions and sales operations are governed by French law. Invalidity of a clause does not nullify the TCS.
