GENERAL TERMS AND CONDITIONS OF SALE – PLASTEEL FORGE

Between Philippe Fossati, Sole Trader (EI), 61 Rue Albert Camus, Le Clos Meinier D8, 83220 Le Pradet (France), registered with the Toulon Trade and Companies Register under SIRET number 44902249000048, acting as manager and publication director of the online store PlaSteel Forge. The store is hosted by Shopify (https://www.shopify.com). The company can be reached by email via the contact form on the homepage. Hereinafter referred to as the "Seller". And any natural or legal person purchasing products or services from the company, hereinafter referred to as the "Buyer" or "Customer".

Article 1 – Purpose
These General Terms and Conditions of Sale (GTC) define the rights and obligations of the parties in the context of the online sale of products or services offered by the Seller.

Article 2 – General Provisions
These GTC govern all sales made through the Seller's websites and form an integral part of the contract between the Buyer and the Seller. They are fully binding on the Buyer, who accepted them before placing an order. The Seller reserves the right to modify these GTC at any time by publishing a new version on the website. The applicable GTC are those in force on the date of payment of the order. The Customer declares having read and accepted all GTC without restriction. The Customer declares being legally capable of entering into a contract under French law and being at least eighteen (18) years of age. The PlaSteel Forge website sells products mostly manufactured by the Seller. Part of the site operates on a made-to-order basis. By placing an order, the customer acknowledges that the dispatch time (manufacturing time) may vary per product and is indicated on each product page. A full refund will be issued if the product is not dispatched within the indicated time, provided the request is made before dispatch.

Article 3 – Prices
Prices are listed in Euros, net of VAT (the Seller is not subject to VAT), on the product order pages. Shipping costs are not included. Customs duties or local taxes may apply in certain cases and are the sole responsibility of the Buyer. The Seller reserves the right to modify prices at any time for future orders.

Article 4 – Online Contract Formation
In accordance with Article 1127-1 of the French Civil Code, the Customer must follow these steps to place an order: product information review, product selection, entry of personal details, acceptance of GTC, order verification and correction if needed, payment, and delivery. The Customer will receive email confirmation of payment and an order acknowledgement. The contract language is French.

Article 5 – Products and Services
Essential characteristics and prices of products are available on the Seller's website. The total amount due is shown on the order confirmation page. The Seller guarantees the price shown at the time of order. Delivery times are clearly indicated on product pages. The Seller undertakes to fulfil orders within the limits of available stock. If a product is unavailable, the Seller will inform the Customer and issue a refund if no alternative delivery date is agreed.

Article 7 – Retention of Title
Products remain the property of the Seller until full payment has been received.

Article 8 – Delivery Terms
Products are delivered to the address provided at the time of order, within the indicated timeframes, excluding order preparation time. In the event of a delivery delay, the Customer may cancel the contract under the conditions set out in Article L216-2 of the French Consumer Code. The Seller will then refund the product and outbound shipping costs. Risk of loss or damage transfers to the Customer upon physical receipt of the products.

Article 9 – Availability
If an item is unavailable for more than 5 working days beyond the expected production time, the Customer will be notified and may request a credit note or full refund.

Article 10 – Payment
Payment is due immediately upon ordering, including pre-orders. Payment is accepted by credit/debit card via PayPal. Cards issued by banks outside France must be international cards (Mastercard or Visa) or any payment method accepted by PayPal. The payment commitment is irrevocable. In the event of payment failure, the sale is automatically cancelled.

Article 11 – Right of Withdrawal
In accordance with Article L221-5 of the French Consumer Code, the Buyer has the right to withdraw from the contract within fourteen (14) days of receiving the order, without giving any reason. The right of withdrawal may be exercised by clicking here or contacting us at: plasteelforge@sfr.fr. Please note that the right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalised, nor to services fully performed before the end of the withdrawal period with the consumer's prior agreement. In the event of withdrawal, the purchase price and standard shipping costs will be refunded. Return shipping costs are the Customer's responsibility. Products must be returned in their original condition and complete (packaging, accessories, instructions). The withdrawal form should be sent to: PlaSteel Forge, 61 Rue Albert Camus, Le Clos Meunier D8, 83220 Le Pradet, France.

Article 12 – Warranties
The Seller provides statutory warranties for conformity and hidden defects. Refund requests should be made by registered letter with acknowledgement of receipt, or via the store's customer email at plasteelforge@sfr.fr.

Article 13 – Complaints and Mediation
Complaints may be submitted by email at plasteelforge@sfr.fr or by post. If the complaint is not resolved within two months, the Customer may refer the matter to a consumer mediator in accordance with Articles L.611-1 to L.616-3 of the French Consumer Code.

Article 14 – Contract Termination
The order may be cancelled by the Buyer by registered letter in the following cases: delivery of a non-conforming product; delivery beyond the agreed deadline; unjustified price increase or product modification. In such cases, the Buyer may request a refund of any deposit paid, plus statutory interest.

Article 15 – Intellectual Property
All trademarks, domain names, products, software, images, videos, texts and other intellectual property are and remain the exclusive property of the Seller. Any reproduction, modification or use of these assets is strictly prohibited.

Article 16 – Force Majeure
The Seller's obligations are suspended in the event of force majeure. The Seller will notify the Customer as soon as possible.

Article 17 – Severability and Modification
If any clause of this contract is declared void, the remaining clauses shall remain in force. Any contractual modification is only valid with written agreement from both parties.

Article 18 – Personal Data Protection
In accordance with EU Regulation 2016/679 (GDPR), the Seller processes personal data for the purpose of selling and delivering products. Data controller: the Seller as identified above. DPO contact: Shopify (https://www.shopify.com). Legal basis: contractual performance. No automated decision-making or profiling is implemented. The Customer has the right to access, rectify, erase, restrict, or port their data, and to lodge a complaint with a supervisory authority.

Article 18 – Applicable Law
All clauses and transactions are governed by French law.

Article 19 – Consumer Information
Statutory provisions of the French Civil Code and Consumer Code reproduced for information purposes (Articles 1641, 1648, L.217-4, L.217-5, L.217-12, L.217-16 of the French Consumer Code).
